The Department of Natural Resources and Environmental Control’s Division of Air Quality will conduct a public hearing (Docket # 2023-P-A-0019) to consider comments from the public on the permit applications submitted by Croda, Inc., for the following federally enforceable draft 7 DE Admin. Code 1102 construction permits concerning their facility at 315 Cherry Lane, New Castle, Delaware:

  • Permit: APC-2023/0041-CONSTRUCTION (NSPS) (FE) for the installation of two (2) 650 hp fire pumps fired on No. 2 fuel oil.  The fire pumps will be permitted to emit (combined) 1.9 tons per year (tpy) NOX, 0.04 tpy SOX, 0.59 tpy CO, 0.04 tpy VOC, and 0.061 tpy PM.
  • Permit: APC-2023/0052-CONSTRUCTION (NSPS) (MNSR) (PTE) (GACT) (FE) for the installation of one (1) 110 MMBtu/hr boiler (designated Boiler 6) fired on No. 2 fuel oil, natural gas, or a blend of landfill gas and natural gas.  The boiler will be permitted to emit 21.7 tpy NOX, 4.8 tpy SOX, 6.4 tpy CO, 2.6 tpy VOC, and 4.46 TPY PM.

If the draft permits are issued and upon completion of construction, the Department will incorporate the operating conditions and limits of the 7 DE Admin. Code 1102 Construction permits into the facility’s existing Title V permit [Permit: AQM-003/00058-Renewal(03)] via Administrative Amendment(s).

The applications, the “draft” construction permits, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the “draft” permit may be reviewed upon request. The materials are posted at de.gov/dnrecnotices. The “draft” construction permits are being submitted to EPA for the standard consecutive thirty (30)day review period.

Public Hearing

The virtual public hearing on the above matter will be held on Wednesday, December 6, 2023, beginning at 6:00 p.m. The web link to the virtual hearing can be accessed through the DNREC Public Hearings site at de.gov/dnrechearings. Closed captioning in over 20 languages, including English and Spanish, is available to attendees via the Zoom platform utilized for all DNREC Public Hearings.

Those wishing to offer verbal comments during DNREC public hearings must pre-register no later than noon on the date of the virtual hearing at de.gov/dnreccomments or by telephone at 302-739-9001.
