Notice of Comment Period: Submission of Title V Permits to the Delaware State Implementation Plan

The Department of Natural Resources and Environmental Control (DNREC), Division of Air Quality is providing notice regarding the submittal of three Title V permits to the Delaware State Implementation Plan (SIP).

The federal Clean Air Act mandates protection of visibility in Class I federal areas, such as national parks, forests and wilderness areas. Under the 1999 Regional Haze Rule, states are required to develop a series of Plans to reduce visibility impairment; with the express intent that, by 2064 the visibility in the Class I areas will be returned to natural conditions. Delaware is proposing to submit three Title V permits (issued December 19, 2023) to the Delaware State Implementation Plan, in relation to Delaware’s Second Visibility Plan, for the following Calpine Mid-Atlantic Generation, LLC facilities: Christiana [AQM-003/00317 (Renewal 5)], Delaware City [AQM-003/00005 (Renewal 5)], and West [AQM-003/00006 (Renewal 5)] Energy Centers. Copies of the permits are posted at de.gov/dnrecnotices.

The Department will accept public comment regarding the submittal of the permits into Delaware’s State Implementation Plan through the close of business on Tuesday, March 5, 2024.
