Proposed Plan of Remedial Action

The Department invites public comment on a proposal to clean-up the Chestnut Run Plaza DuPont, also known as Chestnut Run Plaza Site, Operable Unit 2 (OU-2) (DE-1778) Site located at 984 Centre Road, 135 and 145 Innovation Blvd. in Wilmington. OU-2 consists of 6 tax parcels. The remedy is different depending on the tax parcel.               

The proposed remedial actions for the Site address only soil and soil vapor contamination as the groundwater contamination is being addressed under another operable unit.

Tax Parcel 0703520209 (covers the entire Site)/ Tax Parcel 0703520211 (Building 700), Tax Parcel 0703230032, and Tax Parcel 0703510198 – The proposed remedial actions for the tax parcels under the Delaware Hazardous Substance Cleanup Act (HSCA) include: Environmental Management During Construction- Develop and implement a Contamination Material Management Plan (CMMP); Institutional Controls- placement of an environmental covenant limiting groundwater withdrawal, restricting to non-residential site uses, prohibiting building renovation/demolition without prior DNREC approval, compliance with the CMMP, require a vapor intrusion evaluation for new buildings, buildings with changing use, buildings with structural changes, and buildings not already investigated; and a Remedial Action Completion Report.

Tax Parcels 0703240127 and 0703230031 – The proposed remedial actions for the tax parcels under HSCA include: Environmental Management During Construction- Develop and implement a CMMP; Institutional Controls- placement of an environmental covenant limiting groundwater withdrawal, restricting to non-residential site uses, restricting uses such as hospitals, daycare facilities, elderly housing and convalescent facilities, prohibiting building renovation/demolition without prior DNREC approval, compliance with the LTS and CMMP, require a vapor intrusion evaluation for new buildings, buildings with changing use, buildings with structural changes, and buildings not already investigated; Long-Term Stewardship Plan (LTS)-Development and implement a LTS Plan; and a Remedial Action Completion Report.
