Meeting of the regulatory advisory committee formed by the recently passed Wetlands Stewardship Act.

The Wetlands Stewardship Act, signed by Governor Matt Meyer on July 21, 2026, establishes Delaware’s first comprehensive state program to protect freshwater wetlands and sets up a regulatory advisory committee to guide implementation. The bipartisan legislation was developed to fill regulatory gaps created by a 2023 U.S. Supreme Court decision that narrowed the scope of federal wetlands protections.

The agenda includes approving operating procedures and a “living document” work plan, establishing a shared understanding of how other states have designed their comprehensive wetlands programs and considerations around federal-state regulatory overlap, discussing options developed by the Wetland Definition and Exceptional Value Wetlands Subcommittees, and discussing an approach to keeping the public apprised of and engaged with the RAC process.
