The Division of Waste and Hazardous Substances will conduct a public hearing (Docket #2024-R-WHS-0021) on proposed amendments to the regulations governing reporting pollutant discharges. Public comment period open through March 12, 2026.

The division proposes amendments to the regulations governing Reporting of a Discharge of a Pollutant or Air Contaminant (7 DE Admin. Code 1203) to improve clarity and comprehensiveness for those responsible to report a release or discharge of a pollutant or air contaminant.

The table identifying reportable quantities published under this regulation is static and has not been updated since 2004. It may not reflect changes made at the federal level. Departmental review of Delaware-specific chemicals and their reportable quantities is appropriate to account for any regulatory or programmatic changes within the Department.
