The Division of Waste and Hazardous Substances will conduct a public hearing (Docket #2025-R-WHS-0016) on proposed amendments to the Delaware Solid Waste Regulations. Public comment period open through Jan. 21, 2026.

The Division of Waste and Hazardous Substances proposes amendments to the Regulations Governing Solid Waste (7 DE Admin. Code 1301) including:

  • General updates to formatting, phrasing, style and punctuation
  • Additions, deletions, updates and relocation of definitions
  • Realignment of the application submission requirements between activity types
  • Mirroring of applicable language and clarifications for existing language for Municipal Solid Waste Landfills, Industrial Waste Landfills, Resource Recovery Facilities and Transfer Stations
  • Clarification and updates for Solid Waste Transporters, Infectious Waste Facility, Compost Facility and Recycling Facility requirements

The proposed amendments may be inspected online starting Dec. 1, 2025, in the Delaware Register of Regulations or in-person, by appointment only, by contacting Alison Kiliszek by phone at 302-739-9403 or by email at Alison.Kiliszek@delaware.gov.

The Department will accept public comment through Jan. 21, 2026. Comments will be accepted in written form via email to DNRECHearingComments@delaware.gov, using the online form at de.gov/dnreccomments, or by U.S. mail to the address on this page.
