The Delaware Environmental Appeals Board will hold a hearing on appeal 2021-07.

This will be a hybrid meeting with an in-person option at the DNREC building in Dover and a virtual option via Webex.

Appeal No. 2021-07, filed by Marie Reed, Karen Cheeseman, Simeon Hahn and Jeffrey Richardson, challenges Secretary’s Order No. 2021-W/CCE-0026 dated September 30, 2021.

The order approves applications from the Diamond State Port Corporation for a Subaqueous Lands Permit from the Division of Water and Federal Consistency Certification from the Division of Climate, Coastal and Energy. Both relate to Diamond State Port Corporation’s proposal to construct a new container port on the Delaware River at its Edgemoor property, located at 4600 Hay Road, in New Castle County.

The parties may present evidence, be represented by Delaware counsel or appear personally. The Board shall reach its decision based on the record before the Secretary and evidence presented by the parties. The Board may affirm, reverse, or remand the decision of the Secretary. Pursuant to 7 Del. C. § 6008(a), the Board may enter into executive session for deliberation.
