Notice is hereby given that the City of Dover McKee Run Generating Station having a facility at 880 Buttner Place, Dover, Delaware, has submitted a request for permit renewal pursuant to 40 CFR Part 72.30(c) and 7 DE Admin. Code 1130, Section 7 for operating Permit: AQM-001/00002.  Based on the data and certifications contained in the application, the Division of Air Quality concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and the Department of Natural Resources and Environmental Control (DNREC).  Therefore a “draft/proposed” permit renewal has been prepared.  Corresponding amendments to the 7 DE Admin. Code 1102 permits for Emission Unit 3 and Emission Units 4 & 5 have also been prepared.  The “draft/proposed” 7 DE Admin. Code 1130 permit renewal removes Emission Units 1 & 2, which were retired in 2017, provides allowances for alternative operating scenarios for Emission Unit 3, and modifies the permit language to reflect the current regulatory language.  The modified 7 DE Admin. Code 1102 permits include language to match the renewed 7 DE Admin. Code 1130 permit. There have been no changes to the applicable requirements or existing permit conditions for the Title IV permit renewal.

The application, the “draft/proposed” permit renewals (Permit: AQM-001/00002-IV (Renewal 4) & Permit: AQM-001/00002 (Renewal 4)), “draft/proposed” amendments to the 7 DE Admin. Code 1102 permits (Permits: APC-1981/1121-OPERATION (Amendment 5) & APC-1981/1122 & 1123-OPERATION (Amendment 1)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” permit renewal and permit amendments may be reviewed upon request.  The material is posted at  To submit comments, for additional information or for information regarding how you can inspect the application and draft permit(s), please contact Tracy Mattson at (302) 739‑9402.

The “draft/proposed” permit renewal and permit amendments are being submitted to EPA for concurrent processing.  If there are no significant comments, the “draft/proposed” permit renewal and associated permit amendments will be issued as final permits after expiration of the EPA review period.

A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending July 20, 2020.  A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit renewal’s probable impact.
