Martin Ross has applied for a Rural Area Waiver for his property located on the northeast side of Whitesville Road (CR 64) ~1550’ southeast of Russell Road (CR 455B) near Delmar, Delaware Sussex County Tax parcel 532-16.00-14.01 This request is being made because the soil on the site does not meet the limiting zone requirements in the current Regulations Governing the Design, Installation and operation of On-Site Wastewater Treatment and Disposal Systems in Delaware. The property in question is 10 acres in area and the proposed system will serve a single family with a design flow rate not to exceed 600 gallons per day.
Dawn Hudson has applied for a Formal Waiver for her property located on the south side of Wilgus Cemetery Road (CR 381A) ~1300’ west of Bayard Road (CR 384) near Roxana Delaware Sussex County tax parcel 533-6.00-116.01 This request is being made at this time to use existing monitoring well data along with a current site evaluation to site a second system on the property which will facilitate a subdivision of the property. The request is to site a single family dwelling with a design flow rate not to exceed 600 GPD.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 15 days from this notice. A public hearing request shall be deemed meritorious if it exhibits a familiarity with the application and provides a reasoned statement of the action’s probable impact.
