The Compliance and Permitting Section (CAPS) of the DNREC Division of Waste and Hazardous Substances issues permits for all solid and hazardous waste facilities, such as operating and closed landfills and transfer stations, recycling, composting and resource recovery facilities.

In addition, CAPS staff perform periodic inspections of Delaware facilities for compliance with issued permits and other regulatory requirements. Compliance inspectors are on site daily at major solid waste facilities to ensure they are run according to Delaware regulations.
Delaware’s Regulations Governing Solid Waste (7 DE Admin. Code 1301) require permits to operate solid waste facilities within the State of Delaware. A Delaware Environmental Application Background Statement must be completed and submitted with the permit application.
