Application for a Case-by-Case Maximum Achievable Control Technology (MACT) Determination under Section 112(g)(2)(b)


The requirements of Section 4.0 of Regulation 1138 apply to any owner or operator who constructs or reconstructs a major source of hazardous air pollutants after June 29, 1998 unless the major source in question has been specifically regulated or exempted from regulation under a standard issued pursuant to Section 112(d), Section 112(h), or Section 112(j) of the Act and incorporated in another subpart of 40 CFR Part 63, or the owner or operator of such major source has received all necessary air quality permits for such construction or reconstruction project before June 29, 1998.

Paragraph 4.5.5 of Regulation 1138 identifies the submittal requirements for the application for a case-by-case MACT determination under Section 112(g)(2)(b) of the Clean Air Act Amendments of 1990.

An application for a case-by-case MACT determination has been developed to assist affected sources; the use of this application is optional.
